The peaceful solution of the Kashmir Dispute occupies an important place in its relations of Turkey with India subject to the rule of law as enshrined in the United Nations Charter. The territorial dispute on Kashmir as a matter of fact is a dispute on the interpretation of the Indian Independence Act of 1947, originating from Article 73 of the United Nations` Charter. If the past United Nations Security Council's resolutions on Kashmir are proven to be adopted as binding under Chapter VII, the peaceful solution of the Kashmir dispute can be achievable. The United Nations Security Council resolutions on Kashmir are open ended. The subsequent development of international law in regard to decolonization, made the principle of self-determination on the interpretation of Article 73 of the United Nations Charter as a peremptory norm by which resolutions on Kashmir in fact becomes binding under Chapter VII of the United Nations Charter.
